Plaintiff was a 47 year-old brick layer at the time of the accident. He was employed by the lessee of a building undergoing renovation and was working on a scaffold next to the building's garage door. The defendant's general contractor negligently drove a backhoe out of the building, striking the scaffold, causing plaintiff to fall approximately 15 feet.
