Every year thousands of laborers are killed or seriously injured while working at construction sites. This occurs even though many state and federal regulations, as well as industry standards, require owners, general contractors and sub-contractors to implement a wide variety of safety measures.

Here are some of the alarming facts regarding workplace injury and death:

  1. From 1980 through 1995, approximately 93,338 workers in the U.S. died as a result of trauma suffered on the job.
  2. An average of 16 workers died each day in workplace related accidents.
  3. In 2000, the number of traumatic injuries suffered in the workplace contributed to approximately 5,600 workplace deaths.
  4. A total of 5.2 million injuries and illnesses were reported in private industry workplaces during 2001.

Although workers' compensation aids employees while injured on the job, it is usually not sufficient to fully compensate injured workers for all damages sustained as a result of their work-related accident.

Under New York State Law, employees cannot sue their employers for damages sustained as a result of a work-related accident. In order to receive reasonable compensation for their injuries, workers must commence third-party lawsuits against parties other than their employer. Owners of property, general contractors, sub-contractors, architects, even equipment manufactures may be held responsible when a construction site accident occurs. In addition to workers' compensation benefits, additional damages that can be recovered in third-party lawsuits include pain and suffering, additional wage loss benefits, additional medical benefits and loss of consortium.

Our construction litigation department has been handling complex construction accident cases for years and has a vast degree of knowledge about New York State Labor Law and the Industrial Code.

Our New York construction accident lawyers only represent individuals who are injured by negligence; injured in workplace accidents or by faulty products, equipment or machinery; or through the negligent maintenance of property. The firm has achieved great success in these specialties which are all bound together by a common thread: an individual has suffered serious physical or emotional injury.

Of course, every case is not tried to verdict. We are able to obtain substantial settlements prior to trial because insurance companies and the defense bar know that our firm investigates every case thoroughly and expertly and is always well prepared to try every case.

We do not merely handle cases. We represent real people with real problems on an individual basis. We handle claims in which people have suffered financial loss, personal injuries or even death as a result of negligence.
